Default Reraised pot, KK, and an ace on the turn

My villian is a 37.04/11.11/.82. The turn brings a terrible card because if he had Ax of diamonds, he's now ahead. If he has QQ-TT, he's gonna fold to a bet here and if he called with some broadway cards that are suited a check would definitely give them a free draw. The problem here is his stack is less than the pot so if it bricks on the river (if i do check) and he shoves, can I really call?
