This is 100% completely and totally wrong, and it's extremely important to point out that this is the case in both the US and UK.
If the person being penetrated doesn't say yes (or an equivalent communication) with enthusiasm regularly throughout the act, then you do not have consent according to present day law which makes it rape.
The term you're looking for here is "affirmative consent." It's considered majorly backwards and wrong to go by the "no means no" approach today.
