    If he was dumb enough to not document the fact that he alerted the bank to their mistake and their subsequent response telling him that it is indeed his money then he deserves to get owned.

    Im not sure how exactly the law works, but Id assume that if he did properly document this exchange between the bank and himself then he shouldnt be liable.

    and who the fuck keeps 5mil in a bank acct? I mean seriously to have liquid funds like that you must have >$100m or youre really stupid.

    Under common law, larceny is the taking and carrying away of property of another without consent and with the intent to permanently deprive that person of the property.
    In this case, Ben can argue that he neither took or carried away the property as it was given to him. Further, Ben can argue that he never intended to permanently deprive the bank of the money because he tried to tell officials that the money was not his. Lastly, Ben can argue that the bank consented because they told him the money was his and he could withdraw it. If the jury believes Ben's testimony they can not find him guilty of larceny because he did not have the requisite consent, intent, or taking and carrying away of the money.

    b) It would most likely be used for his property development business which obv can require large sums of liquid cash.
