i read this on another forum.. you need to read closer.
it was more like, if convicted, she faces *up to* 5 years in prison. meaning that there's a huge chance she'll never go to jail.

The problem in cases like this is that the police and prosecutors have too much power.. like there are so many laws with so many "up to" clauses that they can link people messing with someone's video game to "manipulating electronic data" which carries a 5 year maximum sentence.
