If I was villian I would go for stack-a-donk alot here vs shortstack &
check to him on flop, letting him shove all his mid pairs etc & more into my AK.
So if I was in your scenario hyper I would check fold.
Pre-flop is tricky, as peoples 3bet range vs unknown shortstacks are pretty tight - I mean they're going to have to call if you shove pre, so they're unlikely to be 3bet a hand they wouldnt be happy doing this with.
I think a shove pre-flop is best though its pretty close.

you are in position but he raised you (UTG) out of position. Considering pot/stack size pushing pre is best, but I think a fold is better considering his raise in respect to your position. In other spots I'd push.
this can't be a fold pre vs an unknown for 42bb... we are shoving in $78 to win $175 (after rake). We need about 44% equity for shoving to be neutral EV even if cold caller folds 100% and bb calls 100% which is worse case for us obviously.
it's easy to construct a BB range that we have only 40% vs but that would (IMO) be too tight vs an unknown and also assumes 0 FE which probably isn't true although we obviously will have very little.
i like shoving over calling pre. stack sizes are kinda awkward and we are put into awkward spots like this too much. cold caller complicates that even more.
