Just yesterday, Delaware Governor, Jack Markell, made his state the second in the nation to legalize intrastate online gambling by signing the Delaware Gaming Competitiveness Act of 2012, legislation also known as House Bill 333. With amendments drafted by members of Markell's own staff, the Gaming Competitiveness Act was passed by Delaware's Senate on Wednesday by a vote of 14-6-1. The state's House of Representatives passed the legislation earlier this month by a vote of 29 to 8.

There are many states that will look into intrastate poker legislation after the recent government crackdown on American online poker. With PokerStars and FullTilt no longer in the market there will be plenty of US citizens without an online poker room to call home. The federal government could leave these player’s futures in their home-state’s hands by going forward with intrastate regulation. In this type of poker law each individual state could decide whether or not to go forward with online gambling. The states would have full control over licensing, payment processing, and regulating the games. One state which has already attempted to accomplish this is Delaware. While nothing came of the last Delaware Online Poker bill it is safe to say there is a good chance of it happening again in the future.
There isn’t a rich poker history in Delaware. Without a lot of famous players calling “The First State” home there might be some trouble in gaining public support for an internet poker bill. Jennifer “Jennicide” Leigh, a high-stakes professional, is originally from Wilmington Delaware. Other than Leigh it is hard to find a successful big name player from the state. However, Delaware Park runs a yearly celebrity poker tournament hosted by Danny Bonaduce who is best known for his role on the “Partridge Family.” Unfortunately there just aren’t many big names pushing for poker legislation in the state.
In 2010 the state passed a ball allowing table games in three different casinos. Not only could gamblers take part in typical casino games such as blackjack and roulette but they could play poker as well. This was done in hope of raising funds for the state budget. The lawmakers were expecting the creation of nearly 1,000 jobs and over 40 million dollars in revenues from this bill. This was a major win for the state as it seems in the past the pressure of having Atlantic City nearby stopped any and all legislation. With that hurdled cleared three major casinos began running table games in the middle of 2010. It appears the state of Delaware understands how much money can be made from gaming regulation and it would not be a surprise to see the same principles applied to Delaware Online Poker when given the chance.
There are also no laws strictly forbidding home games in a private or social setting. However, there is a bit of gray area with regards to if poker is considered a game of skill or luck in the state of Delaware. The law forbids games of luck to be run outside of casinos but it appears skill games can be played as long as the host of the game does not accept rake or fees. This is a big point heading forward for Delaware Online Poker. If the state deems poker a game of luck then it will be awfully difficult for any online gaming legislation to be passed. Although, with the recent success of poker rooms in their brick and mortar casinos, the cash-strapped state might find itself between a rock and a hard place.
Whether or not intrastate poker becomes a reality in Delaware will depend on how the politicians feel the game can affect the state’s economy. They have already proven to accept other gaming activities to decrease unemployment and raises revenues. One obstacle to Delaware Online Poker could be the lack of a player base. With only 900,000 residents Delaware ranks as the 6th smallest state in the country. Even if online gaming regulation were to happen, allowing casino games, sports betting, and poker to be played over the internet, there may not be enough players to support a card room. While games like blackjack and other casino games take very little money to operate online a game like poker needs constant software updates, customer service, promotions, and other expenses that a smaller player base cannot support. Those wanting to play online in Delaware have a lot to look forward to. With a legislature that understands the amount of money that can be made from gaming it is only a matter of time until internet gambling becomes a reality.
