apparently this guy claims he was playing a HU match and..

Player A) if i lose will you give me 10.50
Player B) (sarcastically, he claims) yeah sure.

poker stars then took 10.50 out of the winner's account without any notice. I wasn't aware this could happen, but I want to make sure no one falls victim to the same stupidity.

I, however, am going to the $500NL tables and asking for $100, then making stars enforce it. Bwahaha.

Doesn't work that way.

While you can make deals, a PS employee must be present in the chat room for them to be valid. The employee will restate all of the terms of the agreement and all players involved must type "agree" before they'll consider it valid.

I remember reading this thread already... hopefully it is the same one since I am not reading it right now.

But from what I remember there was no PS employee there at all when it happened. In fact when the person who "lost" the $10 contacted PS and claimed there was no contract they basically said tough shit. Even though he went on to inform them as to what makes a contract and that there was no consideration thus no valid contract.

Consideration meaning something in return..

Senario 1. Noob: Hey If I loose can I get $10 back?
You: Ya sure *snicker*
You then go on to kick the guys ass.. and to your amazement the next day are missing $10.
(No consideration)

Senario 2. Noob: Hey if I loose can I get $10 back?
You: Sure I guess... if I loose u willing to give me $10 also?
Noob: OK
Anything happens.... Whoever wins wil find money in their bank.
(Consideration)

IMO Senario 1 is crap! If they did this to me I would be really upset and it is not a legal contract at all... no consideration no contract.. simple..

Lee Jones has come into the fold on the 2+2 thread and basically said they won't back down. I really think they should have a support person present during deal making and not just take off the cuff comments from chat logs as gospel.

It's actually a pretty reasonable situation. Read Lee Jones' reply.
