Post subject: Home Games--Legality issues?

So, I attend my friend's home tourney with about 60-70 players every other month or so. Recently my friend was told by a highway patrolman, that he is friends with, that the city sherriffs were keeping an eye on, and waiting for, him to throw another tourney. He decided to make it 21+ this time and decided to limit it strictly to poker and no other gambling (like blackjack) so the house holds no advantage. Apparently, he said he did some research on the subject, but it seems to me like he'd need a gaming license or something to be completely legit?
What do the law books say about these kinds of tourneys? Could he get into a lot of trouble? Could I get in trouble for attending? Anyone have experience with this?

I don't know nutin about it really, but from what I've read recently on FTR (that is Flop Turn River) that legality is city by city. For example, Los Angeles proper? not ok. Fullerton? ok. Check with your city.

any game where the house has an edge is illegal without a license. this includes blackjack, roulette, craps, pai gow, baccarat, keno, slots, etc.
any poker game where the house takes a rake or fee is also illegal without a license. in some states, it's illegal even if the house makes no collection but enjoys the benefit of increased business (e.g. a bar that holds a free tourney).
in most states, gambling of any kind is flat-out illegal, so getting a license is impossible.
generally, though, unraked poker games held at private residences are either carved out from the ban on illegal gambling or simply not prosecuted by the police.
this is not the case in all states. for example, if the total amount on the table exceeds a certain threshhold, your home game may be considered illegal. and technically, all home games are illegal in maryland, though this law is rarely if ever invoked.

The tea-totallers/fundie-fucktards and the anarcho-rightists have it all wrong: Neither prohibition nor zero regulation are the answer...
What is the answer is to allow home/pub tournaments in which a rake is not collected to operate unregulated while offering licences that poker rooms where a rake is taken can buy affordably so as to aboard above the board and with appropriate government oversight...
But then again, logic has never been the forte of either the right or the authoritarian left.
