Last night I was at the final table of a local live tourney. 5 left and I have the shortest stack (was looking to double up as I had 7BB left). I'm in the big blind and the dealer gives me my card which is the ace of diamonds. Unfortunately it flips over while he shoves it to me. I sort of jokingly say I dont mind I'll keep it, not sure if this was allowed but the dealer and most at the table said "ok" and continued dealing. when all cards are dealt I see I have the king of diamonds to go with it. Then one guy said it's a misdeal because this wasnt allowed. It's all fine by me I said, but the dealer still said I was allowed to keep it, so the guy then said we'd have to call the brush. Because the dealer seemed pretty sure and it was a nice hand to play I agreed to call the brush to see what he'd have to say. The brush' ruling was that since I was in the blind it should have been a re-deal right away, not even the usual continue dealing and I get the burn card instead.
I didnt feel like making a big deal out of it, because I didnt really know what the rules are in this situation. Does anyone know the exact rule regarding this? I talked to the brush after I bust, but either I was a bit tired or he couldnt explain it really clear to me, so I'm still not very sure.
For the interested; finished 5th later as JTs <44, J on flop, 4 on river. It's a point tournament over 10 weeks and this was week 2, so no money at stake at the single events

I saw it same thin once in Vegas, the dealer did not seem to know but the BB insisted he get the floor and they called a misdeal. I think it has to do with cheating but tbh idk

I would call this a misdeal, even in your spot. Everyone now knows atleast 1 card. Unfair advantage. Cant do much if the board comes all spades.

I was gonna shove preflop, especially since they saw the ace. 7bb's left and shortest stack at the table.

My understanding is the following:
If the dealer doesn't get out of the blinds when dealing, it's a misdeal. After the blinds, an upturned card should be the BURN, no matter what it is or who has it and the player is dealt a second card at the end of the full deal. If he flips another card after that before finishing the full deal, then it's a misdeal.
Peace,
