Post subject: Dealer folding players cards

After the river was laid, the dealer proceeded to gather all the mucked & burned cards to put back on the deck. Just to thier left was a guy making a decision when he suddenly did not have cards in front of him. He, of course hollered misdeal - obviously, I did not allow this, as this was a large pot with 3 other players. We all know he should have put a chip on his cards, but he is a regular/friend/honest guy - don't like seeing him get screwed. Luckily his were the last 2 cards dragged so we were able to retrive them - which I would otherwise never allow. But he ended up losing his 2 pr & river bet to trips anyway. I try to stick to the rules, but this is a rare situation. In all fairness, is there a better way to handle this if it ever happens again?

Nope. You are responsible for protecting your cards at ALL TIMES. As prickish as it sounds, it's the fairest way to do it.

You should not have retrieved them. They hit the muck, they are dead.

If the dealer ever took my cards before I was ready to fold them, he'd pull back a bloody nub

There's a reason people use guards. At the very least throw a chip on there.
Especially at home games where the table may be small or spacing suboptimal, the responsibility goes both ways. The dealer shouldn't be collecting cards that are in an area where they could be intended for play, but the player also should be using guards and not putting cards where they could be construed as being folded.
