Villain is 40/13 over a 30 hand sample
I don't think he min raises with just one pair as he'd probably call down with that. Is my fold incorrect? I really think his range is weighted towards two pair hands and the bottom of his range would be KQ or JQ

AQ and a set is a small part of the range that plays it this way preflop so i'm heavily leaning towards two pair. but even if he has two pair your equity is pretty good. you have like 36% equity vs all two pairs so i don't see how you would want to dump it to the weak ass min raise.

Tough spot. I feel like one of my biggest leaks atm is refusing to give fish credit ever. I dunno if this is going to far the wrong way lol but his range seems to gave mashed this flop and at worst folding is a small mistake.

I think you should make your 3b $5+ because 40vpip types are not folding to 3bets.

call, peel off a queen, stack his set imo
(he will never fold when you get there imo)

This.
I tend to just ignore min raises when I'm 3betting for value and jack it up to what it would be if they opened a non gay amount. Their calling range against it isn't really changing if you adjust the size.
