Its a Thursday night and I have just tilted off a couple buy ins at 50 leaving me feeling pretty shitty so I decide to hit up the bars with my room mate. We are out at Cafe Mare, a pretty cool joint that has Raggae nights on thursday. The place is jam packed and there are a ton of cute girls. Me and my buddy are working on getting hammered and dancing with the females. Eventually we are on my way out and I see this bad looking girl with a perfect body and a very skimpy shirt on. I make some kinda comment to her, I don't really remember what and she bites and asks if I want to smoke a cigarette. I find out that she's a stripper I'm not surprised because like I said shes bad!
We eventually leave to another bar and tear up the dance floor. This girl is a freak and shes breaking it down in every way possible. I can't wait to take this girl home but somehow get separated from her. She gives me a call in a little bit and tells me her and her friend are at the Long's parking lot. I am way too smashed to drive so I give my keys to my friend who drives over to Longs. When we are pulling into the parking lot we see two cops talking to the girls. At first I try to get Alex to leave but these girls are too fine to leave behind so we decide to wait until the cops are done talking to them.
The girl gives me a call and I pick up and start talking to her. As I am doing this the cops appear and tell me, "You slipped up, we heard you talking to her! Get on the curb!"
At this point I am dumbstruck and don't know what the hell is going on. I figure its a misunderstanding. Eventually they line both girls and me and my buddy up on the curb. I repeatedly ask them why I am being detained and they told me there was a robbery in the area and I match a suspect. About 3 more police cars roll up and one shines his light on us and we each step forward. After I step forward one of the cops says, "Yes, thats him."
At this point I can't believe whats happening. They put me in cuffs and throw me in the back with the stripper. At this point I am ripping her a new one the whole way to the holding cell.
I get detained for 4 hours before they even talk to me. I find out my "accomplice" to the robbery is in another holding cell. Miranda (the girl) and the guy apparently know each other and are talking from cell to cell. Finally the officers read me my rights and question me. I am so drunk here I tell them what I did and who saw me that night but it eventually leads into me blowing up and ranting at these cops about how much bullshit this situation. I am not sure how I came off but I would not be surprised if it wasn't good.
I eventually get moved to county jail where I enter a nasty cell full of 7 tweakers including one guy who beat up a newspaper guy, stole his car and went on a joyride knocking over as many trash cans as possible. This guy is also coming down off of heroine and is smacked out of his mind, extremely hostile, shivering and sweating and basically insane. It smells like piss and spit is all over the floor. Their is no door on the bathroom and no cots, just uncomfortable plastic chairs. We have a TV playing infomercials in spanish. Fucking great.
I immediately inquire about how much my bail is and get the answer. $50,000. My mind is blown, what the hell did I allegedly steal? No one will tell me anything except I am being charged with a felony. I call up my parents and lucky for me my dad is prepared to make the drive down to Santa Cruz and bail me out.
I have a lot of trouble sleeping around these psychos and after 30 hours and no sleep I am going slightly crazy myself. After 1 day of jail I am sure I never could handle a longer term. The food is disgusting, for lunch we got baloney between 2 slices of bread. My dad eventually bails me out and I am very relieved only to find out they will not give me my cloths back because apparently it is evidence for the case. Brand new hat, brand new jeans, brand new shirt all done. At least they let me get my shoes back.
So my arraignment is on the 21st and hopefully I will be able to take care of this bullshit or it is seriously going to fuck up my life.

cops here are so annoying, but I've never heard a story like that. Did you ask for a lawyer? I know people who spent a night in jail in SC, but nothing that bad

Nah, I didn't use any credit cards but I have a lot of people that I know that saw me at every bar. My buddy got let off, and they let him drive my car back to the house.

Thanks dude, yea its crazy. I didn't ask for a lawyer when they questioned me because I knew I was innocent and wasn't worried about saying anything incriminating. I will definitely be getting a lawyer for the arraignment and on.

dude, always get a lawyer imo. Like clearly youre going to need one either way, so you might as well start off with one. I mean I would have tried to reason with the cops at first but you cant allow them to interrogate you without your lawyer. Some cops want to find the person whos guilty, but a lot of cops simply want to find someone that could be guilty. Thats why you need a lawyer.

I talked to my uncle who is a lawyer and asked him if he thought i had a case that would be worth counter suing the city of santa cruz. He said that there really is no case there and I should just focus on finding a lawyer as soon as this goes through the DA's office.

yah that seems to be the case... wrongful arrest doesnt hold much weight as a lawsuit. I mean it kinda makes sense, if every person that beat a trial could sue for big $$$ the system would be busto. But its really fucked up when people get convicted then 20 years later dna evidence surfaces proving their innocence. What do they get? Nothing.

yeah, your probably right but it couldnt hurt to have this "evidence" if shit really went south here for him. Also, you could have stars/FTP do a IP trace to prove the hands were played on your computer. But i think he does have a laptop with wireless to thats kind of pointless too. lol.

An update to the situation:
After getting bailed out I immediately went to the DA's office to try and get the details of my case. They did not have it yet but he told me to call back on Wednesday.
I give them a call today and he tells me the case is still under investigation so nothing official has gone through. He did tell me what he remembers from looking over the police report. Allegedly 2 guys were walking from the bars through a parking lot when 3 guys came up and assaulted them. While they were beating them up one of the guys went through there pockets and stole some money. One of the guys identified me as being one of the assailants. They also incorrectly have me as being friends with the other guy who was detained. They also incorrectly have me as being the boyfriend of Miranda who I had just met. They also have no mention that I had just arrived to the parking lot in a car. I immediately contacted my arresting officer and told him the following and asked him to give me a call as soon as possible so we can sort through these details.
I am hoping Long's has surveillance cameras in the parking lot and that they caught me and Alex pulling into the parking lot. If thats the case this will die quickly.
I can't believe all this happened because someone falsely identified me.

Another funny thing, before I talked to the DA directly I called the DA's office. They were completely incompetent and could not tell me anything. One thing they did tell me was my arraignment is on the 24th. The funny thing is my bail receipt says the 21st. I ask the lady to double check that, I really do not want to mess around with 50,000 dollars. She double checks and says yes it says the 24th.
When I talk to the DA I told him about the differing dates on the computer system and my bail receipt. He does some research and confirms that I should show up on the 21st. If I did not follow up on this and listened to the DA's office I would be out 50k. People treat this like its an ordinary office job, they don't realize what really is at stake here. This whole thing really pisses me off.

what you are talking about is harassment, and i dont think he was really harassed. and thats not to say that i dont sympathize, because i do. it has to be just absolutely blatant for a harassment charge to stick, and generally think you need some history of it. like if the cops just come up to my door repeatedly and say im under arrest for no reason, then i could probably sue for harassment.
on a similar note as santacruz, i got arrested on some bullshit on st. pattys day. these douche bag pigs pulled my friend and i over and said we had a busted tail light, which we found out later was not true. so my friend ends up getting a DUI, and i get a MIP (minor in possession). i was black out drunk, so i actually dont really remember this that well, but my friend said when i got back to the station i accused an officer of going out of town to hang out with little girls (which is actually true cause my friend witnessed it), and then i said to the lady who was taking down my information, "wow, you are so ugly, that must suck to be you." at this point the pigs tackled me down to the ground, stripped me naked and dressed me into jailer clothes. LOL! like i said i dont remember any of this, but my friend told me about it the next day.
what really sucks is that im on probation. yay!

you along with most cops Im encountered just clearly have no ability to reflect on their own place in the world. Just going around judging while convincing themselves they are doing the world some good. There are police officers out there who really are doing a great service to this world and live by the oath they took to protect and serve. Its clear from your last comment that you will not be one of these officers.

euph, you werent there, and you dont understand how dumb these cops are. i was visiting my home town (about 15k people) and they have NOTHING to do, so pretty much anytime they see a car past midnight they will follow you and pull you over.
boost pretty much nailed it. these fuckers are not protecting and serving when i am 2 blocks from home hammered. i fully support cops who investigate real crimes, but this is just ghey.
anyways, i talked to my lawyer and he thinks we might be able to get it dismissed because they had no reason to believe there was a "crime" being committed.
